How the courts are viewing health and safety offences
Under Sections 80 and 81 where an offence has been authorised, or consented to by, or is attributable to connivance or neglect on the part of, a person, being a director, manager or other similar officer of the undertaking, or a person who purports to act in any such capacity, that person as well as the undertaking shall be guilty of an offence and it is for the accused to prove their innocence.
Over time the sentences handed down by the Courts have increased considerably to include heavy fines and of late, jail terms.
This seminar will focus on the following two areas:
- The responsibilities of employees and employers including their obligations under Sections 80 and 81 of the Safety Health and Welfare at Work Act 2005.
- How the Courts have viewed the failures of employees and employers since the introduction of the Safety Health and Welfare at Work Acts 1989 and 2005.
Herbert will review the decisions of the Courts over the years and comment on emerging trends both here and overseas while Harry will address the Duty of Care obligations.
